2. Definitions

• “User” : any individual or legal entity using the Platform.
• “Client” : a User making a service booking.
• “Provider” : a professional or company offering services through the Platform.
• “Concierge” : a partner User referring clients and earning commissions.
• “Service” : any service offered by a Provider through the Platform.
• “Booking” : an order for a Service by a Client through the Platform.

3. Registration and Account

Using certain features of the Platform requires creating an account. When registering, you agree to provide accurate, complete, and up-to-date information.

You are responsible for keeping your login credentials confidential. Any activity carried out from your account is deemed to have been performed by you. In the event of unauthorized use of your account, you agree to notify us immediately.

4. Services and Bookings

The Platform acts as an intermediary between Clients and Providers. MAIA Concierge is not the provider of the services and cannot be held liable for the quality of their performance, which is the sole responsibility of the Providers.

Services are presented for information purposes. Prices, availability, and conditions may vary. The Client receives a booking confirmation by email after validation by the Provider.

5. Payments

Payments are processed through our partner Stripe. We accept Visa, Mastercard, and American Express cards. Payment is secure and banking data is never stored on our servers.

The Client is only charged after the booking is confirmed by the Provider. For instant-booking reservations, the charge is made as soon as the order is validated.

6. Cancellations and Refunds

Each Service has its own cancellation policy (Flexible, Moderate, or Strict) clearly indicated before booking:

• Flexible: Free cancellation up to 24 hours before the service. Full refund.
• Moderate: Free cancellation up to 48 hours before the service. 50% refund beyond that.
• Strict: Free cancellation up to 7 days before the service. No refund beyond that.

7. Liability

MAIA Concierge makes every effort to ensure the quality of the Services offered on the Platform. However, MAIA Concierge cannot be held liable for direct or indirect damages resulting from the use of a Service.

Providers are solely responsible for the performance of their Services and must hold the necessary professional insurance.

8. Commissions

MAIA Concierge charges a commission on each booking made through the Platform. The commission rate is transparent and communicated to Providers upon registration. Partner Concierges earn a 5% commission on bookings generated through their referral.

9. Intellectual Property

All content on the Platform (text, images, logos, design) is the exclusive property of MAIA Concierge SAS or its partners. Any reproduction, representation, or distribution, in whole or in part, is prohibited without prior written authorization.

10. Modifications

MAIA Concierge reserves the right to modify these Terms at any time. Users will be informed of any substantial changes. Continued use of the Platform after modification constitutes acceptance of the new terms.

11. Governing Law

These Terms are governed by French law. Any dispute relating to their interpretation or performance will be submitted to the competent courts of Basse-Terre, Guadeloupe.
